1. PURPOSE OF LEGAL NOTICE AND PRIVACY POLICY

This “Legal Notice and Privacy Policy” (hereinafter, the “Legal Notice”) governs the terms of use of the https://www.tbvq.com website (hereinafter, the “Website”) by any person who accesses it through the Internet (hereinafter, the “User” or the “Users“).

The Website is the property of TBVQ ABOGADOS, S.L.P. In the event that there is a particular condition, especially agreed between TBVQ and a User, and the same is in contradiction with this Legal Notice or other general conditions, the particular condition will prevail.

TBVQ reserves the right to modify this Legal Notice at any time and without prior notice to the User. Therefore, it is the User’s responsibility to check its content each time they access and use the Website.

The Website is not intended for minors, so its use by minors is made under the exclusive responsibility of their parents, guardians or legal representatives.

2. USE OF THE WEBSITE

Access to and use of the Website does not require prior registration by the User and is free of charge for the same, without prejudice to connection costs for each telecommunications network.

The User acknowledges and accepts that, despite the security measures that may be established by TBVQ, access and use of the Website may entail risks to the Users’ or third parties’ computer systems (software and hardware), files and documents, either due to the existence of viruses or other disruptive computer elements. It is the responsibility of the User to have adequate tools for the prevention of the aforementioned risks and, consequently, the User completely and irrevocably exonerates TBVQ from any liability in this regard. Likewise, TBVQ assumes no responsibility for the deficiencies of the Internet or other occurrences attributable to force majeure, to the User or to third parties, which might prevent or impair access to the Website or its correct use. Likewise, TBVQ will be entitled to temporarily suspend, without prior notice, accessibility to the Website, due to maintenance, repair, updating or improvement operations.

3. INDUSTRIAL AND INTELLECTUAL PROPERTY ASSOCIATED WITH THE WEBSITE

Neither the access to or use of the Website grants the User any rights over the trademarks owned by TBVQ nor, in general, any rights on industrial or intellectual property of TBVQ or of third parties with respect to which TBVQ is a licensee.

The User acknowledges that the copyright associated with the Website and its contents is the property of TBVQ or of third parties with respect to which TBVQ is a licensee and, therefore, the exercise of the corresponding operating rights corresponds to TBVQ. However, TBVQ grants the User a non-exclusive, non-sublicensable and non-transferable license to use the Website and its contents, subject to the provisions of this Legal Notice. 5. PRIVACY POLICY-PROTECTION OF PERSONAL DATA

The processing by TBVQ of the personal data of the Users will be governed by the “Privacy Policy” contained in Section 5 hereof.

5.1. Responsible for the processing of personal data

TBVQ, whose identity and contact details are notified in Section 1 hereof, is responsible for the processing of the personal data.

5.2. Purpose of the processing of personal data

At TBVQ we process the personal data provided directly to us by the Users in order to be able to respond to their queries, provide information, communicate with them and generally manage the relationship between TBVQ and such Users.

Personal data will be stored for as long as the User maintains any personal, professional or commercial relationship with TBVQ and does not request TBVQ to delete it.

Based on the information provided, profiles may be developed or segmented, in order to improve the User’s experience in relation to the Website and offer services better suited to their interest. 6. COOKIES

The Website does not register the IP address of the User and only uses its own data storage and retrieval devices (Cookies) of a purely technical nature (which expire on termination of the session or refer to the User’s language preference) for which the consent of the User is not legally required.

7. EXCLUSION OF LIABILITY

The opinions, articles, comments or any other content included in the Website, or accessible from it, are general in nature and in no case constitute legal or tax advice by TBVQ or its professionals or employees. TBVQ disclaims any responsibility for any act or omission by Users, wholly or partially based on or inspired by the aforementioned opinions, articles, comments or content. 8. APPLICABLE LAW AND JURISDICTION

This Legal Notice shall be governed by and construed in accordance with Spanish law. Any conflict or dispute between the User and TBVQ in relation to the Website shall be submitted by the parties to the decision of the courts and tribunals of Barcelona (Spain).
